The terms that govern your access to and use of the Memokiwi Blog website.

These Terms of Service (the “Terms”) govern your access to and use of blog.memokiwi.com and its content (the “Site”), operated by Memokiwi (“we”, “us”, or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to them, please do not use the Site.

1. The Site

The Site is a blog. It publishes articles and notes about product design, backend engineering, and AI infrastructure. Everything on it is provided for general informational purposes only and does not constitute professional, legal, financial, or technical advice for your particular situation.

We may add, change, suspend, or remove any part of the Site at any time, with or without notice. We are not obliged to keep any particular article available, and a published URL may stop resolving.

2. Eligibility

You may use the Site only if you can form a binding contract with us and only in compliance with these Terms and all applicable laws. No account or registration is required to read the Site.

3. Acceptable Use

When using the Site, you agree not to:

  • use the Site for any unlawful purpose or in violation of any applicable law;
  • attempt to gain unauthorized access to the Site, its servers, its databases, or any system connected to it;
  • interfere with or disrupt the Site, including by probing, scanning, or testing its security without our prior written permission;
  • use automated means to access the Site in a way that places an unreasonable load on our infrastructure, or that ignores the directives in our robots.txt;
  • collect or harvest content from the Site for the purpose of training machine learning models or building a competing service, without our prior written permission;
  • misrepresent your affiliation with Memokiwi, or present our content as your own.

4. Intellectual Property

Unless stated otherwise, all content on the Site, including text, images, diagrams, logos, and the design and arrangement of the Site itself, is owned by Memokiwi or its licensors and is protected by copyright and other intellectual property laws.

You may read, share links to, and quote short excerpts of our articles for commentary, criticism, or reporting, provided you give clear attribution to Memokiwi and include a link to the original article. You may not republish an article in full, translate it, or redistribute it in any medium without our prior written permission.

Code samples published on the Site may be copied and adapted freely in your own projects without attribution, unless the sample itself carries a different licence. They are provided without warranty of any kind, and you are responsible for reviewing and testing anything you adopt.

5. Your Submissions

The Site has no accounts and no comment form, so it does not invite user content. If you nevertheless send us feedback, questions, or suggestions by email, you grant us a non-exclusive, worldwide, royalty-free licence to use them without restriction or compensation. Please do not send us anything you consider confidential.

The Site links to websites and services we do not control. We provide those links for convenience only. We do not endorse them and we are not responsible for their content, their availability, or their privacy practices. Your dealings with any third party are solely between you and that third party.

7. Disclaimer of Warranties

The Site and all of its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, secure, or error-free, that its content is accurate, complete, or current, or that any defect will be corrected. Articles describe our own experience at the time of writing and may become outdated without being revised.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Memokiwi and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or in connection with your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for wilful misconduct or gross negligence.

9. Indemnification

You agree to indemnify and hold Memokiwi harmless from any claim, demand, loss, or expense, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

10. Changes to These Terms

We may revise these Terms from time to time. When we do, we update the effective date shown with this document. Material changes take effect when they are posted, and your continued use of the Site after that constitutes acceptance of the revised Terms. We recommend reviewing this page occasionally.

11. Governing Law

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict of law rules. Any dispute arising out of or relating to these Terms or the Site will be submitted to the exclusive jurisdiction of the Seoul Central District Court, unless mandatory law in your country of residence provides otherwise.

12. Severability

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force.
